Price Structure

If the ticket price exceeds DKK 0, a ticket fee of DKK 3.75 per ticket (incl. VAT) and 3.75% (incl. VAT) of the total price will be charged; however, a maximum of DKK 75.00 (incl. VAT) per ticket. The organizer can choose whether the ticket fee is included in the ticket price or added to the ticket price in the form of a ticket fee. If the price for the sale of additional products exceeds DKK 0, Ticketbutler will charge a fee of DKK 2.50 per additional product (incl. VAT) plus 2.50% (incl. VAT) of the total price of additional products. During the ticket purchase, the purchase of associated products and services may be offered such as, but not limited to, SMS tickets, refund protection, etc. Associated services and products may be subject to individual fees.

General Terms and Conditions for Organizers

BilletFix is an online trading platform that mediates tickets and associated services. Event organizers present events through this and can sell tickets etc. for the events.

BilletFix is operated and owned by Ticketbutler ApS. These general conditions therefore apply between BilletFix and its event organizers. No other conditions apply to this relationship unless otherwise agreed in writing by an authorized representative from Ticketbutler.

1. DEFINITIONS.
‘Ticketbutler’ represents Ticketbutler ApS, which is a Danish registered company (CVR no: 38404687) with address at Raffinaderivej 10, 2300 Copenhagen S, Denmark. “Organizer” represents a person or legal entity that uses Ticketbutler’s services with the intention of presenting events and selling tickets for events as well as associated products/services. The “Agreement” represents the agreement entered into between Ticketbutler and the organizer regarding the supply of Ticketbutler’s services to the organizer, where these conditions apply. “Ticketbutler services” represents the services Ticketbutler provides to the Promoter in accordance with the Agreement and these Terms including, but not limited to, the Ticketbutler (including BilletFix) platform on its website(s), domain(s) and mobile application(s).).

2. COLLECTION OF PAYMENTS.
Ticketbutler will receive payments from customers including VAT and fees on behalf of the promoter. If the ticket price exceeds DKK 0, Ticketbutler will charge a fee of DKK 3.75 per ticket (incl. VAT) plus 3.75% (incl. VAT) of the total price; however, a maximum of DKK 75.00 (incl. VAT) per ticket. If the price for the sale of additional products exceeds DKK 0, Ticketbutler will charge a fee of DKK 2.50 per additional product (incl. VAT) plus 2.50% (incl. VAT) of the total price. The payment will be collected directly after the ticket and/or associated products/services have been delivered to the customer, including electronic delivery. The organizer can choose whether the ticket fee is included in the ticket price or added to the ticket price in the form of a ticket fee. During the ticket purchase, the purchase of associated products and services may be offered such as, but not limited to, SMS tickets, refund protection, etc. Associated services and products may be subject to individual fees.

Ticketbutler will deduct DKK 2.50 (incl. VAT) from the event payment per transaction that has been paid by the guest with MobilePay. However, the organizer has the option to opt out of the option for the guest to pay with MobilePay; this must be actively de-selected from the organizer’s dashboard.

3. PAYMENT TO ORGANIZER.
It is necessary for Ticketbutler to be able to refund the ticket price to the buyer if the event in question is cancelled. Therefore, Ticketbutler will pay the ticket revenue to the organizer after the event has been held. The payment will be made within 14 calendar days after the date of the event, provided that the organizer has provided the necessary bank details to complete the transaction. However, Ticketbutler endeavors that the money is transferred within 3 working days after the end of the event. An interest rate of 3.0% is imposed on payments transferred late. The ticket revenue is paid to the account specified by the organizer on the Ticketbutler platform; for this payment associated fees and the like are deducted from the ticket revenue and paid by the organizer.

4. DATA PROCESSOR, OWNER AND DPA
A processing agreement is included as part of this contract. When you create events through Ticketbutler Services, you become a data processor in relation to GDPR. Ticketbutler is the data owner. This contract describes the rights and obligations of the contracting parties. Data processing is subject to applicable laws and regulations with regard to GDPR (EU/2016/679).

The organizer must only process personal data in order to be able to deliver the offered service to the registered and/or ticket buyers for the event in question or if the processing of personal data is required due to legal requirements. Instructions for processing data are provided through this contract and our Privacy Policy.

The organizer ensures that the personal data is not shared with others unless otherwise agreed with Ticketbutler.

The organizer, as a data processor, must, upon request from Ticketbutler, provide evidence of compliance with Article 28 of the GDPR as well as compliance with this contract within a reasonable time. The Promoter will allow and contribute to audits including inspections prepared by Ticketbutler or other inspectors approved by Ticketbutler.

The organizer must take all necessary measures to comply with Article 32 of the GDPR where required. This means that with regard to the current situation, implementation costs and the nature, delimitation, and context and purpose of data processing, the data owner and data processor must implement appropriate technical and organizational conditions to ensure an appropriate level of security for the risk.

Upon termination of the contract, the organizer is obliged to delete or return personal data to Ticketbutler and delete existing copies, unless EU law or the law of the country in question requires storage of the data.

The organizer may ask its ticket buyers, registrants and/or donors for additional data during the purchase, registration and/or donation. However, this may not be compulsorily collected if the data concerns ethnicity, political beliefs, religion, sexual preferences, philosophical beliefs or association memberships, unless otherwise agreed with Ticketbutler.

5. INTELLECTUAL RIGHTS
All intellectual rights in connection with the Ticketbutler services are the property of Ticketbutler including but not limited to all rights associated with the Ticketbutler website(s) and app and the Ticketbutler trademark.

6. USE OF TICKETBUTLER SERVICES
Ticketbutler grants the organizer a non-exclusive, non-revocable, limited right to access and use the Ticketbutler services for the purpose of registering guests for events and displaying event tickets as well-associated products and services.

7. ORGANIZER’S LIABILITY
As the organizer is a data processor, Ticketbutler assumes that the organizer complies with applicable data legislation including GDPR. It is the responsibility of the organizer to convey correct, accurate, up-to-date and relevant information about its events, tickets, prices, conditions, associated products/services etc. via Ticketbutler services. The organizer undertakes that the posted events through Ticketbutler services and the implementation of the events comply with applicable laws, rules and regulations, and that all products and services described on posted event pages are delivered in a satisfactory manner.

8. REFUNDS AND COMPLAINTS
As all transactions are between the organizer and its respective customer(s), Ticketbutler asks all customers to contact the respective organizer for inquiries regarding refunds or complaints. The organizer agrees to comply with a refund, complaint and reclamation policy in accordance with applicable laws and general standards. Ticketbutler may, at its discretion, attempt to mediate refunds, complaints and reclamations; however, Ticketbutler will have no responsibility for an organizer’s inappropriate behavior in connection with refunds, claims and complaints. The Promoter agrees to defend and indemnify Ticketbutler, its affiliates and agents from and against all claims and expenses including attorneys’ fees arising out of or related to transactions between customers or users and the Promoter through the Ticketbutler services.

9. CLAIMS FOR COMPENSATION FROM THE ORGANIZER
All compensation claims from the organizer against Ticketbutler must be communicated in writing to be valid. Claims for compensation for loss or damage against Ticketbutler must be submitted no later than 30 calendar days after the organizer has become aware or should have become aware of the given loss or damage.

10. LIMITATION OF LIABILITY
Ticketbutler can only be held liable for loss or damage in the event of gross negligence or inappropriate intent on the part of Ticketbutler. Ticketbutler cannot be held responsible for indirect loss or damage. Ticketbutler cannot be held responsible for losses or damages arising from the organizer’s deviations from Ticketbutler’s instructions or guidance in the use of Ticketbutler services.

11. ORGANIZER’S INFORMATION
The organizer agrees that Ticketbutler may store and use the organizer’s contact information to provide the organizer with relevant information requested by the organizer and share the organizer’s contact information with users and customers. Ticketbutler may also use the Promoter’s contact information to confirm the Promoter’s identity, request the Promoter’s opinion on Ticketbutler’s services, develop new offers and for market research. Ticketbutler reserves the right to disclose contact information and personal data in order to

(i) comply with applicable laws;
(ii) respond to requests from public authorities (or from requests from judicial, governmental, state-supported or local authorities);
(iii) comply with applicable legal processes or procedures; or
(iv) defend the rights and property of Ticketbutler, Ticketbutler services and/or other users of Ticketbutler services.

12. DISCLAIMER
Except as expressly provided in the Agreement or in these Terms and Conditions, Ticketbutler makes no warranties, express or implied, including any warranty of non-infringement or fitness for a particular purpose. Ticketbutler does not guarantee or warrant that the Ticketbutler Services will be uninterrupted or error-free, or that the Ticketbutler Services will result in any revenue or profit to the Promoter.

13. TERMINATION OF AGREEMENT
Ticketbutler and the organizer are entitled to terminate the agreement, these terms and conditions and end the use of the Ticketbutler service by written notice with 24 hours’ notice. The organizer is obliged to pay the debt in question relating to the use of Ticketbutler services before the termination of the agreement and to comply with the relevant obligations entered into with customers before the termination of the agreement. Ticketbutler is obliged to deliver parts of Ticketbutler services that have already been paid for.

14. CHANGES TO THE AGREEMENT
Ticketbutler reserves the right to change these standard terms and the Ticketbutler privacy policy at any time. All changes will be posted online. By continuing to make use of

Hereafter referred to as “Ticketbutler”.

1. GENERAL
Ticketbutler is an online trading platform that mediates tickets and associated services. Event organizers present events through this and can sell tickets etc. for the events.

When you use the Ticketbutler (including BilletFix) website, app or connected services (hereinafter collectively: “Ticketbutler Services”), you enter into a binding intermediary agreement with Ticketbutler on the terms and conditions of these standard terms and conditions and Ticketbutler’s privacy policy.

By buying a ticket or other service through Ticketbutler Services, you are therefore buying your ticket/service directly from the organizer and Ticketbutler is the sole mediator of this.

In connection with the creation as a user of the Ticketbutler Services, you confirm that you have read and accepted these conditions and Ticketbutler’s privacy policy, and you also confirm that you are of legal age and over 18 years of age.

Ticketbutler reserves the right to change these standard terms and privacy policy at any time. All changes will be posted online. By continuing to use the Ticketbutler Services after changes to these terms of business or the privacy policy, including by purchasing a ticket through the Ticketbutler Services, you express your understanding and acceptance of the changed standard terms and/or privacy policy.

2. ORDER AND PAYMENT
Tickets etc. purchased via Ticketbutler Services at the price stated there plus any fees and costs which are disclosed before the purchase is made. By clicking on the “Buy tickets” button, you submit a request to Ticketbutler and the event organizer to purchase one or more tickets or other service. However, the purchase is not finally completed until you receive an order confirmation or the ordered service per e-mail. Ticketbutler reserves the right to reject your purchase with or without reason.

You can pay with Visa, MasterCard, Dankort, Maestro and complete the payment through MobilePay and ApplePay. Payment can only be made by online payment via Ticketbutler Services. Ticketbutler draws your attention to the fact that, according to the regulations in the Act on Payment Services and Electronic Money, you have the right to object in order to stop or reverse payment transactions in the Ticketbutler Services.

If the ticket price exceeds DKK 0, a ticket fee of DKK 3.75 per ticket (incl. VAT) and 3.75% (incl. VAT) of the total price will be charged; however, a maximum of DKK 75.00 (incl. VAT) per ticket. The organizer can choose to include the ticket fee in the ticket price, which is why a ticket fee will not be charged for some events. If the price for the sale of additional products exceeds DKK 0, Ticketbutler will charge a fee of DKK 2.50 per additional product (incl. VAT) plus 2.50% (incl. VAT) of the total price. VAT is 20% of the ticket price if VAT is imposed on the event. For free tickets, no ticket or card fee is charged. Ticket and card fees are not refunded.

You may be offered to purchase associated services or products including, but not limited to, SMS tickets, cancellation protection, etc. Ticketbutler may charge a different fee than the above for these services.

By purchasing cancellation protection, you agree to the conditions linked to from this page.

Your payment will be withdrawn from your payment card or account when the ticket or other service has been sent to you via e-mail. If payment is not received, the ticket or any other service will be cancelled.

3. DELIVERY
Ticket delivery is via e-mail sent by Ticketbutler in the form of a PDF file. Delivery will take place to the e-mail you have provided in connection with the order, and delivery is deemed to have taken place when the ticket has been sent from Ticketbutler per e-mail.

4. REFUND OF TICKETS AND CANCELLATION
According to the “Act on certain consumer agreements”, you may have a right of withdrawal regarding your purchases. We point out that your right of cancellation is a relationship between you and the organizer.

Tickets. You should be aware that, in accordance with the “Act on Certain Consumer Agreements § 17”, tickets are generally not subject to a right of cancellation. In the event of cancellation, please contact the responsible organizer for further information and a possible refund. Tickets are generally always refunded in such cases. We draw particular attention to the fact that Ticketbutler, as the intermediary of the ticket, is not liable for cancellations etc.

Other services. For other services, according to the Consumer Contracts Act, you have the right to cancel your purchase within 14 calendar days without reason. The deadline is calculated differently depending on whether it is the purchase of a product or the purchase of a service. When purchasing an item, the cancellation period runs from the time you get physical possession of the item. For the purchase of services, the cancellation period runs from the conclusion of the agreement.

The right of withdrawal is conditional on the service being delivered back to the organizer in essentially the same condition and quantity as it was when it was delivered to you.

If you wish to make use of your right of withdrawal vis-à-vis the organizer, you must contact the organizer directly and then return the item to the same. The organizer will then refund the purchase price to you. You can also choose to notify Ticketbutler that you wish to use your right of cancellation by e.g. filling out this form, and Ticketbutler will then contact the organizer about this.

It is emphasized that you have 2 years’ right of complaint under the Sales Act regarding goods and 3 years regarding services that you have purchased via Ticketbutler. However, you must advertise within a reasonable time after you discover a defect.

5. LIMITATION OF LIABILITY
Ticketbutler is not able to resend a ticket if it is lost. Requests for the resending of any lost tickets must be made to the organiser.

Ticketbutler is not liable and cannot be held liable in the event of suspension of payments, bankruptcy, cancellation or rescheduling of the date of holding an event or other complaints regarding the current event. All inquiries in this regard are addressed to the organizer, who is your direct contractual party.

Ticketbutler is not liable and cannot be held responsible for any claims in connection with the copying or resale of tickets.

6. CHOICE OF LAW AND JURISDICTION
Our agreement is regulated and interpreted in accordance with Danish law without regard to the rules of Danish law on choice of law or conflicts of laws. Exclusive jurisdiction for any dispute shall be the courts in Denmark.

7. OTHER IMPORTANT PROVISIONS
Ticketbutler reserves the right for any typographical and/or printing errors in Ticketbutler Services, including in prices and regarding sold-out events.

We also reserve the right to cancel your ticket(s) against a refund of the ticket price (ticket and card fees are not refunded).
